You are responsible for loss reasonably incurred by ADAMS as a direct result of your deliberate, fraudulent, reckless or unlawful:

This clause does not require you to compensate ADAMS to the extent that the loss was caused or contributed to by ADAMS’ own acts, omissions or failure to take reasonable steps to reduce the loss.

• remove material submitted by you;

Where practicable and appropriate, ADAMS will give you an opportunity to respond before taking significant action.

17. Changes to the website and these terms

ADAMS may update the website and these terms from time to time.

The current terms will be published on the website with their effective date. Changes will apply from the date of publication and will not retrospectively remove rights that have already accrued.

If a material change affects a paid membership, registration or service, ADAMS will provide any notice required by law or the applicable additional terms.

18. Complaints and disputes

If you have a concern relating to the website or these terms, please contact ADAMS and provide reasonable details of the issue.

The parties will attempt to resolve the matter promptly and in good faith.

If the dispute cannot be resolved directly, either party may propose mediation in Brisbane, Queensland, through a mutually agreed mediator. Participation in mediation is voluntary unless required under separate agreed terms.

Nothing in this section prevents either party from:

• seeking urgent interlocutory relief;

• exercising rights under the Australian Consumer Law;

• making a complaint to a regulator; or

• commencing proceedings where permitted by law.

19. General provisions

If part of these terms is unlawful or unenforceable, that part will be read down or severed to the minimum extent necessary. The remaining provisions will continue to operate.

A failure or delay by ADAMS in exercising a right does not waive that right.

These terms are governed by the laws of Queensland, Australia. Subject to any right you have to bring proceedings elsewhere under applicable law, the courts of Queensland and the Commonwealth of Australia have jurisdiction in relation to these terms.
